Terms of Use

1. Purpose

These Terms of Use ("Terms") govern access to and use of the wézon website ("the Site"), a free service helping with settling in Switzerland, published by Fulgence Freitas in a personal capacity ("the Publisher"). By using the Site, the user ("the User") accepts these Terms without reservation.

2. Site publisher

The Site is published by Fulgence Freitas, in a personal capacity, remunerated exclusively through the insurance intermediary activity described in Article 3.

3. Insurance intermediary status and remuneration

Fulgence Freitas carries out his insurance intermediary activity as a tied intermediary, within the meaning of art. 43 of the Federal Act on the Supervision of Insurance Companies (ISA), to a Swiss insurance company supervised by FINMA. As such, his activity is covered by that company's own FINMA registration, with no obligation to register individually in the public register of intermediaries. The insurance-related steps offered on the Site that connect the User with an advisor (private and household liability insurance, surety bond guarantee, legal protection insurance, vehicle insurance, supplementary health insurance/LCA) fall within this framework.

The identity of the insurance company concerned is disclosed to the User before any contract is concluded: any personalized offer is sent from a professional address linked to that company, so the User knows unambiguously who they are dealing with before committing.

The comparison of basic health insurance premiums (LAMal) and the accompanying help switching insurer are provided free of charge and without any remuneration for the Publisher, as Swiss law excludes any intermediary commission on basic health insurance.

4. Description of services

The Site offers: free informational content and tools to help with settling in Switzerland (administrative steps, housing, employment, daily life); a comparison tool for basic health insurance (LAMal) premiums, based on public data from the Federal Office of Public Health (OFSP); request forms connecting the User with an advisor to obtain a personalized insurance offer (private and household liability insurance, legal protection insurance, vehicle insurance, surety bond guarantee, LAMal/LCA); administrative documents and forms pre-filled from information provided by the User.

No insurance contract is concluded directly on the Site. The Site does not constitute a firm offer or a contractual commitment: any subscription takes place afterwards, directly between the User, the advisor, and the insurance company concerned.

5. Access to the Site and Client Space

Browsing the Site and its free content requires no account creation. Creating a "Client Space" (optional) lets you save your progress and information to automatically pre-fill your steps. Access to the Client Space is via a magic link sent by email, with no password to create.

The User is solely responsible for the confidentiality of access to their email account, which serves as the authentication method for the Client Space.

6. Nature of the information provided

The administrative information and content on the Site (steps, deadlines, links to official bodies) is provided for guidance and information purposes, to help the User find their way. It does not constitute legal advice, tax advice, or a guarantee of accuracy or completeness at any given time, as Swiss administrative procedures may change.

The information is checked once a month to stay as complete and up to date as possible, without this constituting an absolute guarantee of accuracy at all times.

The User is invited to verify any critical information with the relevant official sources (cantonal offices, federal authorities) before taking any step. The Publisher cannot be held liable for the consequences of information that has become outdated or an error in an external link.

7. Connecting with an advisor

When the User submits a request form, their information is forwarded to an advisor working with the Publisher, who contacts them back, in principle within 24 business hours, to prepare a priced, personalized offer. This connection is free and carries no obligation: the User remains free to accept or decline any offer made.

No price shown on the Site (except for the official LAMal premiums in the comparison tool) constitutes a binding offer, as these coverages (private liability insurance, household insurance, legal protection insurance, vehicle insurance) require an individual assessment of the case before pricing.

8. Protection of personal data

Personal data collected on the Site is processed in accordance with the Federal Act on Data Protection (FADP). See the privacy policy for details.

Data submitted through request forms is used exclusively to prepare an offer and follow up on the User's case. It is neither sold nor transferred to third parties for commercial purposes unrelated to this processing.

In accordance with the FADP, the User has the right to access, rectify, and delete their data, exercisable at the address given in Article 18.

9. Email communications

Two types of email communications may be sent to the User:

Transactional communications, related to a step initiated by the User (request confirmation, case follow-up, information about an ongoing subscription). These communications require no separate consent: they are inherent to the requested service.

Marketing communications, for informational purposes or reminders (useful advice, reminders about the basic health insurance cancellation period). These are only sent to Users who have explicitly given their consent (checkbox not pre-selected), in accordance with the FADP. This consent can be withdrawn at any time, free of charge and without justification, via the unsubscribe link in every marketing communication or by writing to the address given in Article 18.

10. Cookies and audience measurement

The Site may use audience measurement tools (Google Analytics) and advertising tracking tools (Meta Pixel), activated only after the User's explicit consent via the banner provided for that purpose. Without consent, these tools remain inactive. The User can change their choice at any time.

11. Intellectual property

All elements of the Site (text, structure, visual identity, tools) are the property of the Publisher or its partners, unless otherwise stated, and are protected under Swiss copyright law. Any unauthorized reproduction or reuse is prohibited.

12. Links to third-party sites

The Site contains links to third-party sites (cantonal and federal bodies, e-démarches, insurer websites). The Publisher has no control over the content of these third-party sites and disclaims all liability regarding their content or availability.

13. Liability

The Publisher makes every effort to ensure the accuracy of the information published, without absolute guarantee. Within the limits permitted by Swiss law, the Publisher's liability cannot be engaged for any indirect damage resulting from use of the Site or a decision made based on its informational content. This limitation does not apply in case of gross or intentional misconduct.

14. Service availability

The Publisher strives to ensure the Site's accessibility but does not guarantee continuous availability and may interrupt access, notably for maintenance, without notice or compensation.

15. Changes to these Terms

The Publisher reserves the right to modify these Terms at any time. The version in force is the one published on the Site on the date of consultation. In case of a material change, Users with a Client Space will be informed.

16. Termination

The User may request deletion of their Client Space and data at any time, without justification, at the address given in Article 18.

17. Governing law and jurisdiction

These Terms are governed by Swiss law. This English version is provided for information only; the French version is the authoritative text in case of dispute over interpretation. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Geneva, subject to mandatory provisions applicable to consumers.
